Suspension and Debarment: What to Know and How to Avoid It
The FAR provides wide discretion to federal agencies to protect its interest from unscrupulous contractors. One of the most common remedies in the agency’s toolbox is to consider whether to temporarily suspend a contractor from winning new federal awards, or to exclude a vendor from such new awards for an extended period of time. While the FAR identifies a number of factors for an agency to evaluate, each agency must apply one or more of those factors to specific facts. Agency Suspension and Debarment Officials (SDOs) are generally the focal point for the agency’s investigation and application of these rules. This class will review the special suspension and debarment authorities, the role of the agency SDO, and the procedures the SDO often uses.
