In Government contracts pricing often times dictates both pre-award and post-award risk and associated audit rights. A contractor’s pricing approach: cost-based and price based– dictates whether it is submitting “certified cost or pricing data” or “data other than certified cost or pricing data”. For certified cost or pricing data, the Government’s audit rights extend until three years after final payment. For data other than certified cost or pricing data, the Government’s audit rights are limited to any time before award and do not apply to cost or profit information for the commercial item.
